At Midland Aquatics Solutions we make every effort to ensure the information we put on our website is accurate and up to date. However, as some information is derived from third-party organisations such as manufacturers and suppliers we cannot guarantee the information is accurate beyond question. We will not be liable to you/or any third party for any consequential or incidental damages (including, but not limited to, loss of revenue, loss of profits, wasted expenditure, loss of privacy and loss of data) whatsoever that arise out of or are related to the use of this website and/or any information contained therein.
We make every effort to ensure that the items placed on the website are kept in stock. However we cannot guarantee that at the time you place an order for an item, it will be in stock. This may be as a result of increased demand during promotional phases or that manufacturers have been out of stock of this item. We will make every effort to get the item into stock as soon as we can but any information given with regards to due dates will only be an estimation. You have the right to cancel the order should the delivery estimate not be satisfactory but we cannot guarantee the arrival of such items and will not be held responsible for any circumstances resulting from a product failing to meet its estimated delivery point.
Whilst we do endeavour to offer accurate and up to date information on our website, we will not be responsible for the compatibility of items within a single order or as part of subsequent orders. We respectfully request that you thoroughly check that any items you order are compatible and suitable for their intended purpose.

Please make sure you are fully aware of the guaranteed terms of the products you purchase from us. Whilst we distribute such products, the guarantee is issued by the manufacturer and may contain specific stipulations or may not even carry a guarantee. We will uphold the conditions of such guarantees but will not be able to act in the case of an item falling out of its guarantee criteria.
Your aquarium and any lighting supplied are guaranteed for defective parts and workmanship for a period of two years from the date of purchase. This guarantee is valid with proof of purchase only. The guarantee is limited to repair or replacement only and does not cover consequential loss or damage to animate or inanimate objects. This guarantee is valid provided the aquarium is placed in a suitable location that is flat and level and has been installed in accordance with the installation instructions and care guide This guarantee excludes aquarium breakage due to misuse, chips, stress cracks caused by improper support or other breakage. This guarantee is valid only under normal operating conditions for which the unit is intended. It excludes any damage caused by unreasonable use, negligence, improper installation, tampering, abuse or commercial use. The warranty does not cover wear and tear or parts which have not been adequately or correctly maintained. This does not affect your statutory rights. Your aquarium warranty may vary depending on the producer, model or size. Please see the manufactures warranty booklet for further information.

Limited Liability Agreement
All aquatic products and related systems have an inherent risk of failure, leaking, or flooding. Midland Aquatic is not responsible for any loss of fish, personal injury or death, property loss, or damage arising out of the use of the aquarium, failure of an aquarium for any reason, including failure due to manufacturing defects, or failure of any of the various components including but not limited to filtration, heating, lighting, and other electrical systems. It is the responsibility of the customer to carry insurance that covers any consequences of flooding or leaking or failure for the above-described incidents as well as pay the deductible on any such claim which will not hold Midland Aquatic liable if such an event occurs. It is the responsibility of the customer to take measures of placing their aquarium in a properly designed location with adequate floor drainage to limit the risk of damage due to flooding, leaking, or failure and to assess the structural integrity of the place to ensure it is strong enough to support the heavyweights of the aquarium. Midland Aquatic is not responsible for fire or electrical risks associated with any product. Be sure to follow all manufacturer’s recommendations and ratings, only plug aquarium equipment into GFCI-rated outlets and be sure to turn off all electrical equipment prior to servicing the aquarium.
